An ACAS settlement is typically calculated by estimating the potential Employment Tribunal award. This includes a Basic Award (based on age, length of service, and weekly pay), a Compensatory Award (for actual financial loss like lost earnings), and any outstanding notice pay or unpaid wages. ACAS conciliators use these figures as a baseline for negotiation.
Yes. For ordinary unfair dismissal, the Compensatory Award is capped at the lower of 52 weeks’ gross pay or a statutory maximum limit (which is adjusted annually, approximately £115,115 as of recent years). However, there is no statutory cap on compensation for discrimination claims.
The standard ACAS Early Conciliation period lasts up to one month. This can be extended by up to 14 additional days if both parties agree and there is a reasonable prospect of settlement. If conciliation fails, ACAS issues a certificate allowing you to proceed to an Employment Tribunal.
