Maternity Leave & Annual Leave FAQ
Everything you need to know about your holiday rights while on maternity leave in the UK.
Yes. Under UK law, you continue to accrue both your statutory annual leave (5.6 weeks per year) and any additional contractual holiday entitlement throughout your entire maternity leave period, including both Ordinary and Additional Maternity Leave.
Your employer cannot refuse your right to take the leave you have accrued. However, they are legally allowed to manage when this leave is taken, which may mean requesting you take it immediately before or after your maternity leave, or during a specific period, provided they give proper notice.
If your employment ends (e.g., you resign or are dismissed) after or during maternity leave, your employer must pay you in lieu of any accrued but untaken statutory annual leave, up to the date your employment officially terminates.
Yes, the statutory minimum of 5.6 weeks (28 days for a full-time worker) can include bank and public holidays. If your contract states ’20 days plus bank holidays’, your total statutory entitlement is still capped at 28 days, but your employer may offer more contractually.
